REALTOR sues REALTOR Organization Over Hate Speech Rules

by procareercenter | Dec 2, 2021

Montana REALTOR Brandon Huber, who is also a pastor, has filed suit against the Missoula Organization of REALTORS® over where free speech ends and hate speech begins.

Huber alleges in his lawsuit that the Missoula Organization of REALTORS® is violating the Montana constitution by discriminating against him in the exercise of his religious beliefs. The lawsuit also alleges that a new prohibition on hate speech by the REALTORS® is too vague in Contract Law to be enforced.

The National Association of Realtors in 2020 strengthened its professional standards to address hate speech. The new standard has been tested several times over the past year. The latest case interpretation requires Realtors to remove confederate flags from listing photos.
